1. Scope of Services

We act as an independent travel agency and advisor. We arrange and book travel services (including flights, cruises, accommodations, car rentals, and tours) on behalf of our clients. We do not own, operate, or control airlines, hotels, cruise lines, tour operators, or other suppliers.

2. Contracting Parties

All bookings are subject to the supplier’s terms (e.g., airline, cruise line, tour operator). We serve solely as an intermediary; your contract is concluded with the supplier, who is responsible for performance.

3. Payments

• Deposits may be required at the time of booking.
• Final payments must be received before the supplier’s deadline; otherwise, the booking may be canceled per supplier policy.
• Accepted payment methods and due dates will be communicated prior to booking.
• Agency service/consultation fees are non-refundable.

4. Cancellations & Changes

Supplier-specific change and cancellation penalties apply. Requests must be made in writing. Agency service/consultation fees remain non-refundable regardless of supplier refunds.

5. Client Responsibilities & Travel Documents

You are responsible for valid passports, visas, vaccinations, health documentation, and compliance with entry/exit requirements. We are not responsible for denied boarding, entry refusal, missed connections, or costs arising from incomplete/invalid documentation.

6. Travel Insurance

Comprehensive travel insurance is strongly recommended (medical, baggage, trip cancellation/interruption, supplier default). If you decline insurance, you accept full responsibility for any loss that insurance would have covered.

7. Supplier Responsibility & Force Majeure

We are not liable for acts, errors, or omissions of third-party suppliers, nor for force majeure (e.g., weather events, pandemics/epidemics, strikes, civil unrest, government actions, schedule changes). Any remedy lies against the supplier according to their policies.

8. Limitation of Liability

To the maximum extent permitted by law, our liability shall not exceed the amount of agency service fees paid directly to Dreamscape Adventures by Lexi LLC. We disclaim liability for indirect, incidental, or consequential damages.

9. FTC & Advertising Disclosures

If affiliate links, sponsored posts, or promotions are used, we will provide clear and conspicuous disclosures in accordance with applicable FTC guidelines.

10. Affiliate Disclosure

Dreamscape Adventures by Lexi LLC may participate in affiliate marketing programs. When you click on supplier or partner links and make a booking or purchase, we may earn a commission at no additional cost to you. These commissions do not affect the price you pay, nor do they influence the services you receive. We only partner with suppliers that we believe provide value to our clients.

11. Data Retention (Summary)

We keep customer records only as long as necessary to provide services and comply with legal/tax requirements. For detailed schedules and deletion rules, please see our Privacy Policy.

12. Governing Law & Venue

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Exclusive venue is the state or federal courts located in Maricopa County, Arizona.

13. GDPR Notice for EU/EEA Residents

If you are an EU/EEA resident, your personal data will be processed under GDPR principles. Legal bases include: contract performance (Art.6(1)(b)), legitimate interests (Art.6(1)(f)), legal obligation (Art.6(1)(c)), and consent where required (Art.6(1)(a)). Special-category data (e.g., health information) may be processed with explicit consent (Art.9(2)(a)) or vital interests (Art.9(2)(c)). International transfers to the U.S. or other countries may occur; where feasible, safeguards such as the European Commission’s Standard Contractual Clauses (SCCs) and appropriate supplementary measures will be applied.

By booking with us, you acknowledge that you have read, understood, and agree to these Terms & Conditions as of the Effective Date above.

1) Who We Are

Dreamscape Adventures by Lexi LLC (“we”, “us”, “our”) is a U.S.-based travel agency providing advisory and booking services.

5) International Transfers & Safeguards

For EU/EEA data transferred outside the EU/EEA (including to the U.S.), we consider using Standard Contractual Clauses (SCCs) and implement additional safeguards where appropriate.

6) Retention & Deletion (US-Focused)

We retain personal information only as long as reasonably necessary for the purposes described in this Policy, to comply with law, and to protect our legitimate business interests. When information is no longer needed, we delete or de-identify it.

• Booking & itinerary records: up to 7 years after trip completion.
• Payment & billing records: up to 7 years.
• Customer support communications: 24 months after the last interaction.
• Marketing contacts & preferences: until you opt out or after 24 months of no engagement.
• Web logs & analytics: cookie lifetime or up to 13 months.
• Security & fraud logs: typically 12–24 months, longer if needed.
• Do-Not-Sell/Share & privacy request logs (CPRA): 24 months from response.
• Legal holds / disputes: retained until resolution, then deleted.

Deletion & de-identification: secure erasure, aggregation, or de-identification consistent with industry practice. Backups are removed on the next rotation. Where law requires continued retention, use is restricted to that purpose only.

7) Your GDPR Rights & Request Process

EU/EEA residents may have rights to access, rectify, erase, restrict, object, and data portability. To submit a request, email dreamscapeadventuresbylexi@gmail.com. We will verify your identity and respond without undue delay within statutory timelines.

8) CCPA/CPRA Notice (California Residents)

We disclose data to service providers (travel suppliers, payment processors, IT/hosting) for operational purposes. We do not sell personal information for monetary consideration and do not share personal information for cross-context behavioral advertising. If this changes, we will update this Policy and provide a “Do Not Sell or Share My Personal Information” link.
